Walnut Tree Puppy Sales Contract, Health Guarantee, and Spay/Neuter Contract

The following health guarantee constitutes a binding agreement between Walnut Tree Bernedoodles, hereafter referred to as “WTB” and the below-identified purchaser, hereinafter referred to as “Purchaser” for the sale and purchase described of one puppy or dog identified and described below under Puppy Information hereinafter referred to as “Puppy.”

Breeder Responsibility


WTB strives to place puppies in “Safe Loving Homes.”  WTB guarantees that the puppy will be delivered to Purchaser in good health, with all the required vaccinations. All WTB puppies are vet checked, de-wormed, and have had their first vaccinations.  Each puppy will stay with WTB until 8 weeks of age.  Each puppy will have at least one thorough examination by a qualified veterinarian.

Purchaser’s Responsibility

WTB requires that the Purchaser have Puppy examined by a veterinarian of their choice within 7 days of receiving their Puppy. WTB wants Purchaser to be fully assured of their Puppy’s health. Purchaser must provide proof that the puppy was seen by Purchaser’s veterinarian within 7 days of receiving the puppy. This proof can be the invoice purchaser is given when checking out at the veterinarian's office. Please text a copy of the vet record to Sara at 828-260-0950 or email to wtbernedoodles@gmail.com. Failure to provide proof that the puppy was examined by Purchaser’s veterinarian, will void this health guarantee. WTB requires the purchaser to keep your Puppy on a regular vaccination schedule and routine de-worming by a licensed veterinarian. WTB also requires that the Puppy be kept on a monthly heartworm preventative. During the time between receiving your Puppy and the completion of puppy shots (approx. 16 weeks), it is the Purchaser’s responsibility to keep the Puppy away from public places such as pet stores, Puppy Preschool, or parks. A puppy’s immunity is not strong enough to be exposed to potentially deadly viruses (such as parvovirus) before the puppy vaccinations are completed. Purchaser agrees to provide TLC food, give daily exercise, provide indoor living quarters, a reliable fence system, and regular veterinarian care. The purchaser is responsible to keep the dog fit and not allow the dog to become overweight, as this can lead to hip dysplasia down the road. The puppy is not to compete in agility competitions (involving a lot of jumping), frisbee, or allowed to run up down the stairs in the first year of life as this can lead to hip dysplasia down the road. WTB reminds Purchaser that Bernedoodles are intelligent animals and require consistent training, socialization, and attention. WTB strongly encourages Purchaser to enroll their puppy in socialization classes, obedience training, and expose them to people of all ages, after the full regiment of vaccinations is complete. At any time, should the Purchaser be unable to keep the Puppy, the Purchaser is to notify WTB so we can assist in finding a new home. Purchaser agrees to never relinquish a puppy to a shelter. WTB likes to remain in contact with Purchasers. We appreciate periodic updates and photos throughout your puppy’s life.

Genetic Health Guarantee

WTB provides a 2-year guarantee against any serious genetic illness that affects your Puppy’s quality of life. WTB guarantees the Puppy to be in good health at the time of transfer of ownership to the purchaser. If the Puppy has become overweight, had inadequate diet or exercise, improper veterinary care, be over or under-vaccinated, been involved in agility (excessive jumping) or running up and downstairs in the first year of the Puppy’s life, this health guarantee is null and void. If a diagnosis of any hip dysplasia is found within the first two years, WTB requires a Penn Hip report and a letter from Purchaser’s veterinarian that the puppy has received proper check-ups and has not been overweight. Death due to injury, accident, owner’s neglect or any other cause will not be eligible for a refund. WTB reserves the right to have the Puppy examined by a veterinarian of their choice before a replacement is made. After these requirements have been met, Purchaser may choose a replacement Puppy from any of our upcoming available litters, subject to availability; or WTB will refund Purchaser up to ½ the purchase price of the puppy. WTB does not expect you to return the Puppy as they are part of Purchaser’s family unless the proper medical care is more than Purchaser can afford. WTB does genetic testing on all of its breeding dogs prior to them entering the program, therefore, WTB does not see this as an issue. Should Purchaser decide to return the puppy to WTB, shipping will be at the Purchaser’s expense.

Walnut Tree Spay/Neuter Agreement:

Proof of spaying or neutering must be received by WTB by the time the puppy is 16 months old. In the event that the dog’s health does not allow this agreement to be honored, WTB must be provided with a statement from your veterinarian that this dog is not yet in physical or emotional condition for surgery. Based upon the veterinarian’s evaluation of this dog, the puppy buyer will contact the veterinarian and establish the earliest date that the procedure can be performed. The puppy buyer will notify WTB in writing, at which time all other conditions of the contract will apply and be enforced. This is the responsibility of the puppy buyer, not the veterinarian, to ensure that WTB has received verification that the surgery has been performed. Failure to comply with this agreement by the date below, unless otherwise agreed to in writing, will be considered a breach of the Contract. By my signature below, I agree to have this dog spayed/neutered by the time he or she is 8 months old. I understand that this spay/neuter agreement is an agreement that this dog will NOT produce a litter of puppies, either purposely bred or by accidental breeding. I also agree that should the puppy not be altered, I will return said puppy back to Walnut Tree Bernedoodles with no refund, or be charged $5,000 minus the amount already paid for the puppy. This is the price WTB sells its puppies with breeding rights. This health guarantee is between WTB and the original Purchaser, as listed below, and does not transfer ownership if the Puppy is sold or transferred. If an examining veterinarian should find the Puppy has been abused, subjected to trauma, or neglected, this health guarantee is null and void. WTB is not liable under any circumstances to the Purchaser or any third party for consequential, incidental, or special damages resulting from the Puppy or related to the Puppy. Upon execution of this contract, all veterinary care and its costs are the sole and exclusive responsibility of the purchaser. Purchaser and WTB agree to the terms and conditions of this health guarantee and the spay/neuter agreement. By signing below, this constitutes a legal and binding health guarantee
